Larceny from a Person: The taking and carrying away of property from the person of another with the intent to permanently deprive. Larceny over $250: The taking and carrying away of the property, with a value exceeding $250, of another with the intent to permanently deprive. Embezzlement: Embezzlement is a form of larceny by a person who is in a position of trust or confidence. The Commonwealth must prove (1) that the defendant fraudulently converted to his or her personal use (2) property under his or her control by virtue of a position of trust or confidence (3) with the intent to deprive the owner of the property permanently. There are many forms of embezzlement dependent upon the position of the person charged with converting the property.
